What this trade is and what it is for
The trade "Preparation of technical designs, graphic and drawing work" is field no. 62 of the single unqualified (free) trade under Act No. 455/1991 Coll. (the Trade Licensing Act). It allows you to do business legally in the area of creating technical and graphic materials - from technical drawing and the processing of plan documentation, through work in CAD systems, to graphic design and drawing work.
As an unqualified (free) trade, it is among the trades listed in Annex 4 to the Trade Licensing Act. This means it requires no professional qualification - you need not prove any education or experience. It is enough to meet the general conditions under Section 6 and to notify the field. The licence arises on the very day of notification (Section 10(1)(a)).
What falls under this trade (and what does not)
Field no. 62 covers in particular:
- the preparation and drafting of technical designs and plan documentation,
- technical drawing, redrawing and digitisation of plans,
- work in CAD systems (2D/3D modelling as a basis),
- graphic work - graphic design, DTP, typesetting, vectorisation,
- drawing and illustration work.
Where the boundaries lie with neighbouring activities:
- Project activity in construction (preparation of a building's project documentation, including certification by an authorised person) is a regulated trade under Annex 2 and requires authorisation under Act No. 360/1992 Coll. (CKAIT / CKA). Field no. 62 covers only preparatory and drawing work, not the issuing of certified project documentation.
- Designing land consolidation works (field no. 61) and designing electrical installations (field no. 63) are separate fields of the unqualified trade.
- Design, styling, window-dressing activities and modelling (field no. 67) and advertising, marketing, media representation (field no. 66) are likewise separate fields - if you also carry out these activities, notify them separately (within the single unqualified trade).
- Activities reserved for authorised surveyors or other regulated professions do not fall under this field.
If you are unsure about classification, we recommend discussing the specific scope with the Trade Licensing Office.
Conditions for obtaining it under the law
General conditions (Section 6 of the Trade Licensing Act):
- full legal capacity (Section 6(1)(a)),
- clean criminal record (Section 6(1)(b)) - under Section 6(2), a person is not regarded as having a clean record if they have been finally convicted of an intentional criminal offence committed in connection with the business or with the subject of business applied for, and where the conviction is not disregarded as if it had not occurred.
Professional qualification: It is not proven for this trade. This is an unqualified (free) trade (Annex 4) for which the law requires no special conditions under Section 7. You therefore need not prove education or experience in the field.
Responsible representative (Section 11): Not mandatory for an unqualified trade. You may appoint one voluntarily, typically when doing business through a legal entity or where you yourself do not meet some condition. One person may act as responsible representative for no more than four entrepreneurs.
