An unqualified (free) trade (field No. 42) covers the manufacture of other products of the processing industry that cannot be classified under any of the specifically named manufacturing fields of the unqualified trade. It requires no professional qualification - it is enough to meet the general conditions under Section 6 of the Trade Licensing Act (No. 455/1991 Coll.) and to notify the trade. The trade licence arises as early as the day of notification.
Clean criminal record (Section 6(1)(b) of the Trade Licensing Act; a person who has been finally convicted of an intentional criminal offence committed in connection with business or with the subject of business is not considered to have a clean criminal record, unless they are deemed not to have been convicted).
Professional qualification is NOT documented - this is an unqualified (free) trade under Annex No. 4 to the Trade Licensing Act; the special conditions under Section 7 (neither education nor experience) do not apply.
Optionally, a responsible representative may be appointed under Section 11, but it is not mandatory (one person may be a responsible representative for at most 4 entrepreneurs).

What the trade is and what it is for
The trade "Manufacture of other products of the processing industry" is field No. 42 of the single unqualified (free) trade "Production, trade and services not listed in Annexes 1 to 3 of the Trade Licensing Act". It is a so-called residual (catch-all) field of processing production: it covers the manufacture of products that cannot be classified under any of the specifically named manufacturing fields of the unqualified trade (fields No. 7 to 41).
In practice, this licence allows you to legally manufacture and sell products of the processing industry for which no separate field provides. Because this is an unqualified (free) trade (Annex No. 4 to Act No. 455/1991 Coll.), you do not have to prove any education or experience - it is enough to meet the general conditions and to notify the trade.
What falls under this trade (and what does not)
Field No. 42 has no exhaustive list of products in its content scope (Government Regulation No. 278/2008 Coll.) - its scope simply reads "Manufacture of other products of the processing industry". It is therefore used exclusively as a supplement for such production as does not belong to any of the specifically named fields.
Typically falling here:
- preparation and stuffing of animals (taxidermy),
- completion and final finishing of products of processing production not listed elsewhere,
- manufacture of other specific items of the processing industry that are not listed in any other field.
Where are the boundaries? The key rule reads: if there is a separate field of the unqualified trade for a given product, you notify it under that field, not under No. 42. Beware especially of field No. 41 "Manufacture of school and office supplies, except paper products, manufacture of costume jewellery, brush-making and confection goods, umbrellas, souvenirs", which is itself very broad and absorbs most small-scale production. Under field No. 41 (not under No. 42) fall, for example:
- manufacture of stamps, hand printers and labelling machines,
- manufacture of pens, pencils and other school and office supplies,
- manufacture of costume jewellery and ornaments from base metals, glass, wood or leather,
- manufacture of besoms, brushes, brooms and paint rollers,
- manufacture of confection fasteners (buttons, press studs, zips), canes, umbrellas and parasols,
- manufacture of matches, lighters, candles, artificial flowers and souvenirs.
In addition, separate fields govern, for example, the manufacture of toys and sports goods (field No. 38), the manufacture of plastic and rubber products (field No. 19) or the processing of wood (field No. 12). You use field No. 42 only when the product does not belong to any of these specialised fields.
Beware also of the craft and regulated trades (Annexes 1 and 2) and of production subject to a concession (Annex 3) - for example the production of spirits (Section 27, Annex 3) or explosives. Such activities never fall under the unqualified trade. If you are in doubt about the classification of a specific product, we recommend asking the Trade Licensing Office in advance.
Legal conditions for obtaining it
Because this is an unqualified (free) trade, it is enough to meet only the general conditions under Section 6 of the Trade Licensing Act:
- full legal capacity (Section 6(1)(a) - for a minor it may be replaced by a court's approval of the legal representative's consent),
- clean criminal record (Section 6(1)(b) - the obstacle is a final conviction for an intentional criminal offence committed in connection with business or with the subject of business).
Professional qualification is not documented. The special conditions under Section 7 (education, experience) do not apply to an unqualified trade - you do not have to submit an apprenticeship certificate, diploma or confirmation of experience.
You may also operate the trade through a responsible representative under Section 11. For an unqualified trade, however, this is not mandatory; it is your voluntary choice (e.g. if you do not yourself wish to be in daily contact with the operation). One person may be a responsible representative for at most 4 entrepreneurs.
How to notify or obtain the trade step by step
- Complete the Unified Registration Form (JRF). With this single form you fulfil the trade notification and the related registrations (tax office, ČSSZ, health insurance company).
- Select the fields. In the notification state field No. 42; at the same time you may, without a further fee, also notify other fields of the unqualified trade at once (for one administrative fee).
- Submit the notification. You may do so at any municipal Trade Licensing Office, online via the rzp.gov.cz portal, or at a Czech POINT branch.
- Prove your identity and pay the fee. The office verifies the clean criminal record itself from the Criminal Records Register.
- Await the entry. The office makes the entry in the Trade Register within 5 working days and assigns an identification number (IČO). The licence, however, arises as early as the day of notification.

- Proof of the legal grounds for using the registered office, if it differs from the place of residence.
- Administrative fee for the trade notification: CZK 1,000 (for an electronic submission CZK 800) - paid once regardless of the number of notified fields.
- Adding a further field of an existing unqualified trade: CZK 0 (free of charge).
- Entry deadline: within 5 working days of the notification.
Frequently asked questions
Do I need an apprenticeship certificate or experience in the field?
No. This is an unqualified trade, so you do not document professional qualification. It is enough to meet the general conditions under Section 6 - full legal capacity and clean criminal record.
Can I manufacture anything under this field?
Not quite. Field No. 42 is a catch-all and is used only for products that do not belong to another, specifically named field of the unqualified trade (especially the very broad field No. 41), nor to a craft, regulated or licensed trade.
How much do I pay if I want other fields straight away?
For the first trade notification you pay CZK 1,000 (electronically CZK 800) regardless of the number of fields. A later addition of a further field of the unqualified trade is free of charge.
When can I start manufacturing?
The trade licence arises on the day of notification, so you can start doing business immediately. The entry in the register and the assignment of an IČO take place within 5 working days.
Do I have to have a responsible representative?
No. For an unqualified trade a responsible representative under Section 11 is only a voluntary option.
