How to start By notification at the trade licensing office

The unqualified (free) trade (field No. 82) is the residual category of the unqualified trade, covering manufacturing, trading and servicing activities that cannot be classified under any of the specifically named fields of Annex No. 4. It does not require a professional qualification – it is enough to meet the general conditions under Section 6 of the Trade Licensing Act (Act No. 455/1991 Coll.).

Conditions for operating
Full legal capacity (Section 6(1)(a) of the Trade Licensing Act); for a minor it may be replaced by a court’s approval of the legal representative’s consent.
Clean criminal record (Section 6(1)(b) and (2) of the Trade Licensing Act) – proven by an extract from the Criminal Records Register, which the office obtains itself for Czech citizens.
Professional or other special qualification is NOT submitted – this is an unqualified (free) trade under Annex No. 4 to the Trade Licensing Act (Section 25).
The option to appoint a responsible representative under Section 11 (not compulsory for an unqualified trade; one person may be the responsible representative for no more than 4 entrepreneurs – Section 11(7)).
The trade authorisation arises on the day of notification (Section 25, or Section 10 of the Trade Licensing Act).

What the trade is and what it is for

The trade “Manufacturing, trade and services not elsewhere classified” is field No. 82 within the single unqualified (free) trade (subject of business: Manufacturing, trade and services not listed in Annexes 1 to 3 to the Trade Licensing Act). Annex No. 4 to the Trade Licensing Act numbers the fields of activity from 1 to 82, with numbers 54 and 81 cancelled – so there are 80 active fields. This field (No. 82) is the last on the list. It is a so-called residual (catch-all) category: it covers manufacturing, trading and servicing activities that by their nature belong to the unqualified trade but cannot be classified under any of the preceding specifically named fields.

The field serves mainly entrepreneurs whose activity is new, combined or so specific that there is no exact name for it on the list. Because it is an unqualified trade, to carry it on you do not need to prove any education or practice – it is enough to meet the general conditions under Section 6 of the Trade Licensing Act.

What falls under this trade (and what does not)

Field No. 82 covers activities that have the character of an unqualified trade but do not belong to any other field of Annex No. 4 – for example specific brokering, advisory, administrative, manufacturing or trading services that have no name of their own on the list.

What, on the other hand, does not belong here:

  • Activities for which a specific field exists in Annex No. 4 (e.g. “Wholesale and retail”, “Brokering of trade and services”, “Advertising activity, marketing and media representation”). In such a case you notify the given field directly, not the residual category.
  • Activities falling under craft trades (Annex No. 1), regulated trades (Annex No. 2) or licensed (concession) trades (Annex No. 3) – these require a professional qualification, or a concession.
  • Activities that are not a trade at all (e.g. liberal professions under special regulations – attorneys, doctors, tax advisers, etc., under Section 3 of the Trade Licensing Act).

If you are unsure about the classification, the competent Trade Licensing Office will assess the boundary according to the actual content of your activity.

Statutory conditions for obtaining the trade

Since this is an unqualified (free) trade, it is enough to meet only the general conditions under Section 6 of the Trade Licensing Act:

  • full legal capacity (Section 6(1)(a)), which for a minor may be replaced by a court’s approval;
  • a clean criminal record (Section 6(1)(b) and (2)) – the clean criminal record is proven by an extract from the Criminal Records Register, which the office obtains itself for Czech citizens.

Professional qualification is not submitted for this trade. You do not have to submit any document on education, an apprenticeship certificate or practice – this is the main advantage of the unqualified trade over craft, regulated or licensed trades.

Responsible representative (Section 11): not compulsory for an unqualified trade. You may appoint one voluntarily, typically if a legal person does business or if you do not want to manage the activity directly yourself. One person may be the responsible representative for no more than 4 entrepreneurs (Section 11(7)).

How to notify or obtain the trade step by step

  1. Fill in the Unified Registration Form (URF) – the single form by which you simultaneously notify the trade, register for income tax at the tax office, and notify the start of activity to the social security administration and the health insurance company.
  2. Submit the notification at any municipal Trade Licensing Office, electronically via the rzp.gov.cz portal, or at a Czech POINT contact point.
  3. Prove your identity and pay the administrative fee.
  4. Wait for registration – the Trade Licensing Office enters you in the Trade Register within 5 working days of delivery of the notification (Section 47 of the Trade Licensing Act).

For notifiable trades, the trade authorisation arises as early as the day of notification (Section 25, or Section 10 of the Trade Licensing Act), not only on registration – so you can start doing business immediately after meeting the conditions. Documents and fees

  • Identity document (identity card or passport).
  • Completed URF.
  • Proof of payment of the administrative fee.
  • Clean criminal record – the office obtains the extract from the Criminal Records Register itself for Czech citizens.
  • Administrative fee: CZK 1,000 for notifying the trade, or CZK 800 for electronic submission.
  • Extension by another field of the unqualified trade is free of charge (CZK 0).

Frequently asked questions

Do I have to prove education or practice?

No. This is an unqualified trade, for which professional qualification is not submitted. It is enough to meet the general conditions under Section 6 – full legal capacity and a clean criminal record.

Can I notify several fields of the unqualified trade at once?

Yes. There is only one unqualified trade with 80 active fields (numbered up to 82, with numbers 54 and 81 cancelled) and you may notify several of them at the same time for a single administrative fee. A later extension by another field is free of charge.

When can I start doing business?

The trade authorisation arises on the day of notification (Section 25, or Section 10 of the Trade Licensing Act). You can therefore start doing business immediately after submitting the notification, provided you meet the statutory conditions; the office enters you in the Register within 5 working days (Section 47).

What is the difference between field No. 82 and a specific field?

Field No. 82 is a residual category for activities without a name of their own on the list. If your activity has its specific field in Annex No. 4, notify that one directly.

What if I am unsure about the classification of my activity?

Contact any municipal Trade Licensing Office. It will assess, according to the actual content, whether the activity falls under this field, under another field of the unqualified trade, or whether it requires a craft, regulated or licensed trade.
