How to start By notification at the trade licensing office

An unqualified (free) trade (field No. 38) for the manufacture, repair and maintenance of sports goods, games, toys and prams. It requires no professional qualification - it is enough to meet the general conditions under Section 6 of the Trade Licensing Act No. 455/1991 Coll., and the trade licence arises on the day of notification.

What this trade is and what it is for

The trade "Manufacture, repair and maintenance of sports goods, games, toys and prams" is field of activity No. 38 within the single unqualified (free) trade (Annex No. 4 to the Trade Licensing Act No. 455/1991 Coll.). It entitles you to manufacture, repair and maintain a wide range of sports equipment, indoor and outdoor games, toys and prams. It is a practical choice for manufacturers, craft workshops, repair shops and smaller brands that wish to do business in sport, leisure and children's goods.

Because this is an unqualified trade, no professional qualification (no education or experience) needs to be documented in order to operate it. It is enough to meet only the general conditions under Section 6 of the Trade Licensing Act. The trade licence arises under Section 10(1)(a) as early as the day of notification.

What falls under this trade (and what does not)

Under field No. 38, according to the content scope (Government Regulation No. 278/2008 Coll.), fall in particular:

  • manufacture, repair and maintenance of goods and equipment for sport (especially balls, rackets, bats, poles, skis and ski bindings, sledges, bobs, skates, fishing tackle, hunting equipment, mountaineering gear, sports gloves, bows, crossbows)
  • equipment for gyms and athletics facilities, sports flying devices, diving breathing apparatus
  • manufacture of games and toys from wood, plastic, textile and metal, including dolls and their clothing, mechanical toys (trains, cars, scooters, tricycles), board and table games, playing cards, models, building sets and puzzles
  • manufacture of prams and dolls' prams and their parts
  • repair and maintenance of the above range (servicing of equipment, grinding and waxing of skis, replacement of components)
  • assembly and completion of the above products from finished parts

Boundaries against other trades (expressly not included here): The content scope of field No. 38 excludes the manufacture of bicycles and sports vehicles - these fall under field No. 36 "Manufacture of bicycles, wheelchairs for the disabled and other non-motorised means of transport" (and motorised vehicles fall under the fields of engineering production). Likewise, this does not include the manufacture of sports clothing and footwear, helmets, saddlery and leather goods, orthopaedic devices, weapons and ammunition, nor boats and sports vessels. The sale of sports goods and toys is a separate activity falling under field No. 48 "Wholesale and retail". Beware also of safety: toys placed on the market must meet the technical requirements under government regulations and toy safety legislation (CE marking); this obligation is, however, independent of the type of trade.

Legal conditions for obtaining it

As this is an unqualified (free) trade, you only have to meet the general conditions under Section 6 of the Trade Licensing Act:

  • full legal capacity (may be replaced by a court's approval of the legal representative's consent for a minor),
  • clean criminal record (proven by an extract from the Criminal Records Register, which the office obtains itself).

Professional qualification is not documented for this trade - you do not need any education or experience in the field. This is the main advantage of an unqualified trade over craft trades (Sections 21 and 22), regulated trades (Annex No. 2) or licensed (concession) trades (Annex No. 3).

Responsible representative (Section 11): If you did not meet the conditions yourself, or if a legal person is doing business, a responsible representative may be appointed. For an unqualified trade no professional qualification is required of them either, but they must meet the general conditions under Section 6. One person may perform the function of responsible representative for at most 4 entrepreneurs.

How to notify the trade step by step

  1. Complete the Unified Registration Form (JRF) under Section 45a - with a single form you notify the trade and may at the same time register for income tax, social security and health insurance.
  2. Select the field(s) of activity - for an unqualified trade you state field No. 38; in the same notification you may, without an increase in the fee, also notify further fields of the unqualified trade.
  3. Submit the notification at any municipal Trade Licensing Office, online via the rzp.gov.cz portal, or at a Czech POINT branch.
  4. Pay the administrative fee and await the entry.

Deadlines: The Trade Licensing Office makes the entry in the Trade Register and issues the extract under Section 47, usually within 5 working days of the notification. The licence, however, arises as early as the day of notification.

Frequently asked questions

Do I need an apprenticeship certificate or experience for this trade?

No. This is an unqualified trade for which professional qualification is not documented at all. It is enough to meet the general conditions under Section 6 (full legal capacity and clean criminal record).

Can I notify several fields of the unqualified trade at once?

Yes. The unqualified trade is a single one and comprises more than 80 fields of activity (the highest ordinal number of a field is 82). In one notification you may state any number of fields for one administrative fee. A later addition of a further field is free of charge.

When can I start doing business?

The trade licence arises under Section 10(1)(a) on the day of notification. You will receive the extract from the Trade Register usually within 5 working days.

Does the manufacture of bicycles belong here too?

No. The content scope of field No. 38 expressly excludes the manufacture of bicycles - that falls under the separate field No. 36 "Manufacture of bicycles, wheelchairs for the disabled and other non-motorised means of transport". Field No. 38 covers other sports goods (skis, skates, sledges, balls, rackets and the like), games, toys and prams.

Can I also sell toys under this trade?

The manufacture and repairs themselves fall under field No. 38. For purchase and resale (wholesale or retail) it is advisable to notify field No. 48 as well. Both fields can be added to one notification without an increase in the fee.

Do my toys have to meet any standards?

Yes, toy safety is governed by separate legislation (CE marking, technical requirements). This obligation applies regardless of the type of trade; verify the details with the relevant authority or the Czech Trade Inspection Authority (ČOI).
